House Minding - Client Service Agreement
Utah Relocations (is a DBA of E & R LLC) upholds high ethical standards in order to provide you with exceptional House Minding services. Please read carefully and understand our terms of service.
Utah Relocations (UR) is owned and operated by E & R LLC. UR provides services to their clients in accordance with the client’s requests, provided that all requests are, at the sole discretion of Utah Relocations, for lawful, ethical and moral house minding services in respect of the personal needs of the client.
Utah Relocations shall use its reasonable endeavors to meet agreed upon timescales for delivery of services, but such timescales shall be estimates only. Every effort, within reason, will be attempted to fulfill the booking.
Utah Relocations reserves the right to refuse any service requested; and/or withdraw the continuation of any service; provided that Utah Relocations informs the client of any refusal or withdrawal as soon as reasonably possible.
Client shall provide proof of address, and photo identification in a form acceptable to Utah Relocations upon request.
Client shall provide a completed and signed copy of a credit card authorization form for payment of services.
Services are based on an hourly rate, which may vary according to the day, time and/or location of the services. After the first hour of service for any one house minding visit the rate is prorated to 30 minute increments and billed at the half hourly rate. If an errand reaches past the 30 minute increment then the hourly rate is billed (example, if the duration of the service is 1 hour and 45 minutes, the client will be billed for 2 hours). Time is billed from the time we leave our office to commence the house minding duties and ends upon leaving the clients home or when the task is complete, if finished outside of the home.
Utah Relocations warrants that it will, always, exercise reasonable care and skill in providing the services and, as far as reasonably practical, such provision will accord with the client’s request and instructions.
Clients must rely on their judgement and discretion in selecting, hiring and using Suppliers (third party vendors and, or service providers). Utah Relocations will not be responsible for any goods or services provided by the Supplier but will use its reasonable endeavors to assist clients in any subsequent dealings with Suppliers.
Contracts which clients enter into with Suppliers are independent and not connected to or subject to these Terms and Conditions. Utah Relocations disclaims any and all liability for any act or omission of any Supplier or any loss incurred by a Client as a result of any act or omission of a Supplier hired by a Client.
Utah Relocations shall, on its sole cost and expense, maintain in force adequate business general liability, errors and omissions and other forms of appropriate insurance to cover company employees only, and shall not cover any employee of the Client or third parties.
The client understands that Utah Relocations is not insured or licensed to operate/perfom some tasks e.g: childcare, medical assistance, plumbing, electrical and some transportation services etc.
Utah Relocations shall treat all confidential information that it holds in relation to the Client as confidential and applying the same security measures and degree of care to such Client Confidential Information as Utah Relocations applies to its own confidential information; and not disclose the Client Confidential Information outside of the company to any other person without the Clients consent.
Utah Relocations may disclose the Client Confidential Information only to the extent required by law, by any governmental or other regulatory authority or by a court or other authority of competent jurisdiction.
Any client of Utah Relocations may request any information that we hold and what personal data we possess. Clients can also request that we: correct, erase or no longer use their personal data for marketing purposes. All data related queries must be sent in writing and sent to vicky [at] UtahRelocations [dot] com.
Collection & Delivery service
We will ship or personally hand deliver items at the clients request. Contents of any package must be disclosed to the concierge handling the collection or delivery. We will not handle any packages that contain illegal, dangerous, unethical, unlawful items or items that may be unsafe, cause harm or injure our concierge’s or the receiving person. Pick up and drop off addresses must be a reputable place of business, hotel or residence. All pick up and drop off locations must be safe to enter. Further more if the concierge feels in danger or uncomfortable at any time the client will be notified and another arrangement will be made. These are safety protocols for our concierge’s and others. By using our services you agree to this strict policy.
Services are based on an hourly rate. The hourly rate is subject to change. Minimum charge is a one hour service fee then additional time is charged in half hour increments. Services must be booked and paid for at least one week in advance to ensure availability of service.
The hourly rate is based on our standard business hours (Monday to Friday 9am to 5pm except public/statutory holidays) and one weeks notice must be given to book a house minding job. A 50% surcharge is added to the hourly rate should you require services after-hours or on statutory holidays. Some exceptions to the rate may be made by prior arrangement and approved by Utah Relocations.
If the job covers an extended period of time, such as 2+ months, the monthly service will be billed the week before the next month commences.
If the client has an urgent request while away and it is less than 24 hours notice the hourly rate is doubled. Please note that we will do everything we can to accomodate but urgent requests are subject to availability.
The first 10 miles per visit is complimentary. No charge. Miles are calculated from our closest office (our offices are in Pleasant View, Ogden & Kaysville) to the clients residence. Overage mileage beyond the 10 miles per visit is charged at $1.20/mile.
No cancellation fee is charged if cancelled before 48 hrs of rendering services. In this regard you will be given a full refund. If cancelled within 48 hours a 50% fee is charged. If cancelled the same day of service no refund is given and the full amount is charged.
Please note that our concierge schedules are set on a weekly basis with some minor tweaks 3 days before commencing the job, if needed. We still have to pay our concierges if you cancel within 48 hours. That is why there is a charge for cancelling close to the booking.
A dedicated concierge will be appointed to you however, there may be times when your concierge is unavailable due to inclement weather, sickness, vacation or for any other reason. We will provide a sub-concierge to fill in for your principal concierge.
Client must complete the credit card authorization form which will be kept on file and Client will be charged for any outstanding concierge services rendered. Credit card information must be up to date. If a new card is issued – a new authorization form must be completed.
Utah Relocations will send you an online link to complete payment electronically.
Cash or check is accepted upon prior arrangement to approved Clients only. No cash or check will be accepted on the first 3 house minding jobs. A $35 service fee is charged for returned checks.
Corporate accounts may be approved by prior arrangement to be billed monthly and must be paid in full within the month following by credit/debit card or company check. Any checks that cannot be processed because of insufficient funds will be charged a $35 fee on top of the balance owing to recover bank fees.
Payments rendered are considered fully earned and non-refundable. Only exception is as per our cancellation policy.
Client is responsible for all purchases and third party vendor purchases.
Expenses we incur on behalf of Client are not included in any concierge fees and will be the Client’s responsibility to pay. Should a concierge make a purchase on behalf of the Client, there will be a 10% service fee added to the purchase amount to be reimbursed by the Client. We recommend the Client pay for goods and services prior to the concierge collecting any item to avoid the 10% service fee or provide a payment method for a concierge to make the purchase on the Client’s behalf.
Added expenses may include, but not limited to, parking fees, excessive mileage (over 10 miles), groceries, urgent shipping costs etc. We will provide proof of receipt on any additional expenses.
Our employees are our biggest asset. For a period of two years following the termination of the Agreement, Client will not call on, solicit, or take away any of Utah Relocations staff for house minding or errand services. Breach of this clause would cause liquidated damages of 25% of Client’s yearly package. The parties hereto expressly agree and acknowledge that actual damages for purposes of this Subparagraph would be difficult to ascertain and that the amount set forth above represents the parties’ reasonable estimate of such damages. This clause would in no way limit any other remedies available to Utah Relocations.
Liability: Utah Relocations agrees to provide services stated in this contract in a reliable and trustworthy manner. IN CONSIDERATION OF THESE SERVICES AND AS AN EXPRESS CONDITION THEREOF, CLIENT EXPRESSLY WAIVES ANY AND ALL CLAIMS AGAINST UTAH RELOCATIONS, UNLESS ARISING FROM GROSS NEGLIGENCE ON THE PART OF UTAH RELOCATIONS. Utah Relocations will not perform work that is illegal or puts Utah Relocations in danger. Utah Relocations will not be responsible for any keys Client has asked to be mailed. Utah Relocations will not be responsible for any damage inside or out of the home due to any act of nature.
Third Party Vendors: Utah Relocations may contract third-party vendors to provide services requested. Utah Relocations will use their best efforts to obtain qualified providers, but cannot guarantee the quality of services provided by others. Utah Relocations will not be responsible for any damage caused by third-party such as but not limited to dry cleaning, food delivery, plumber, and furnishings. Utah Relocations cannot be responsible for third-party appointments. If the third-party arrives later than the time specified, Utah Relocations is not held liable and will be compensated for their time.
Emergencies: Client agrees to authorize Utah Relocations to handle any emergencies that may arise. In the event Client cannot be contacted, Client authorizes Utah Relocations to use their best judgment and to be available at the hourly rate to oversee the circumstances.
Expiration & Modification: This Agreement shall remain in effect until such time as one or the other Party provides written notice of cancellation. This Agreement may be modified or amended as necessary after negotiations initiated by either Party. If agreement is reached, only a written instrument signed by both Parties will modify or amend this Agreement. No waiver or modification of any of the express terms of this Agreement shall be effective unless it is in writing and signed by the Party against whom the waiver or modification is asserted; and each of the Parties irrevocably waives any right to assert any verbal waiver or modification by the other of any of the express terms and conditions of this Agreement. This agreement is severable so that if any provision hereof is deemed illegal or unenforceable, the remainder of the Agreement shall remain fully valid and in full force and effect.
Additional Provisions: This Agreement shall be governed by and construed according to the laws of the State of Utah, and shall not be construed against the drafter. The parties agree that any suit or action relating to this Agreement shall be instituted and commenced exclusively in the federal or state courts in Weber County Utah, and the parties hereby waive the right to change such venue and hereby consent to the jurisdiction of such courts. ANY LIABILITY ON THE PART OF UTAH RELOCATIONS AS DETERMINED BY A COURT OF LAW WILL BE LIMITED TO AN AMOUNT NOT TO EXCEED ONE MONTH’S RETAINER. If Utah Relocations must bring suit or other action to collect on unpaid invoices or seek remedy of any other breach of contract, Utah Relocations shall be entitled to an award of costs, reasonable attorney’s fees and interest at the maximum rate permitted by law in addition to any other relief awarded.
The terms and conditions of this Agreement may be modified or amended as necessary in writing and signed by both parties. By agreeing to this Client Service Agreement, I indicate that I understand, agree to and accept the terms and conditions as contained herein.
